التصريح بالممتلكات بين النص و عدم فاعلية التطبيق

الملخص
يعد اجراء التصريح بالممتلكات احدى الاليات التي حاول المشرع الجزائري من خلالها مكافحة كل أشكال الفساد و ذلك تطبيقا لما ورد في اتفاقية الامم المتحدة و الاتفاقيات الاخرى التي صادقت عليها الجزائر كإجراء وقائي و ذلك من خلال اخضاعها لبعض القيود الشكلية و الإجرائية قبل تقلد الموظفين مناصبهم بختلاف صفاتهم التي يصعب تحديدها و تمييزها في بعض الحالات و اثناء و بعد انتهاء مهامهم ذلك ليس افتراضا لسوء النية في شخصهم و إنما هو حماية للمال العام من كل أشكال الإستغلال الغير مشروع التي قد تصيبه و التي عملت الجزائر على حمايته منذ الاستقلال , كما أنه وضع سياسة إجرائية و جزائية عن كل الانتهاكات كعدم التصريح او التصريح الكاذب بالممتلكات و لكن تلك الإجرءات لن تكون ناجعة في حال وجود ثغرات عدة في النص الجزائي يمكن من خلالها أن يفلت الموظف من العقاب . ABSTRACT : The property declaration procedure is one of the mechanisms through which the Algerian legislator tried to combat all forms of corruption, in implementation of what was stated in the United Nations Convention and other conventions ratified by Algeria as a preventive measure, by subjecting it to some formal and procedural restrictions before employees assume their positions of different qualities. Which is difficult to identify and distinguish in some cases, during and after the end of their duties. This is not an assumption of bad faith in their person, but rather it is a protection of public money from all forms of illegal exploitation that may affect it and which Algeria has worked to protect since independence, and it has established a procedural policy for all Violations such as not declaring or falsely declaring property But these procedures will not be effective if there are several loopholes in the penal text through which the employee can escape punishment. .
