تدخل المشرع الجزائري لحماية الطفل من المحتوى غير المشروع، الألعاب الإلكترونية نموذجا

الملخص
في ظل تطور وسائل الاتصال الحديثة وانتشار مضامين إلكترونية تحتوي على مواد غير مشروعة أو ضارة تهدد سلامة الطفل، تمحورت هذه الدراسة حول موضوع الألعاب الإلكترونية - باعتباره أكثر المواضيع التي تستهوي الطفل في الفضاء الرقمي - كنموذج للمحتوى غير المشروع، فقد لاقت تجارة هذه الألعاب رواجا كبيرا عبر مختلف دول العالم في السنوات الأخيرة، وأصبحت سلبياتها تشكل تحدٍ كبير بالنسبة للتشريعات الحديثة، لذا فقد سعى المشرع الجزائري لحماية الطفل من أخطارها حماية موضوعية من خلال منظومته القانونية في القانون العام، على الخصوص الدستور وقانون العقوبات، والقوانين الخاصة في مقدمتها قانون حماية الطفل والقانون المتضمن الوقاية من الجرائم المتعلقة بتكنولوجيات الاعلام والاتصال، وقوانين أخرى ذات صلة، بالإضافة إلى الحماية الإجرائية والمؤسساتية من خلال الرقابة والتفتيش في الاتصالات وتنظيم هيئات وطنية مهمتها توفير الرقابة الوقائية للاتصالات الإلكترونية، والتدخل الردعي من خلال المصلحة المركزية لمكافحة الجرائم السيبرانية للأمن الوطني. الكلمات المفتاحية: المحتوى غير المشروع، الطفل، الحماية، الألعاب الإلكترونية. Abstract: In light of the development of modern means of communication and the spread of electronic content containing illegal or harmful materials that threaten the safety of children, this study focuses on the subject of electronic games - as the most attractive subject for children in the digital space - as a model of illegal content. The trade in these games has become very popular in various countries in recent years and its negatives have become a major challenge for modern legislation, therefore, the Algerian legislator sought to protect children from their dangers with objective protection objectively through its legal system in public law, especially the constitution and the penal code, and special laws, foremost of which is the child protection law and the law containing the prevention of crimes related to information and communication technologies, and other related laws. Moreover, it provides procedural and institutional protection through monitoring and inspection of communications and organizing national bodies whose mission is to provide preventive monitoring of electronic communications, and deterrent intervention through the central interest to combat cybercrimes for national security.
