النظام الإجرائي للدعاوى الإدارية في قانون الإجراءات المدنية والإدارية "القانون 08-09 المُعدَّل بالقانون 22-13"

الملخص
تتناول الدراسة موضوع يعتبر من أهم مواضيع القانون الإداري، يتمثل في الدعاوى الإدارية التي تعتبر آلية تساهم على حمل الإدارة على احترام مبدأ المشروعية، هذه الدعاوى التي تختلف عن بعضها البعض من حيث موضوعها وهدفها، بل وتختلف كذلك من حيث الشروط المطلوبة فيها، ناهيك عن الاختلاف الذي عرفته بعضها قبل تعديل قانون الإجراءات المدنية والإدارية وبعد تعديله. وتتناول الدراسة أيضا في الجزئية الثانية دعوى من أهم الدعاوى الإدارية، وهي دعوى الإلغاء والتي تعتبر الأكثر استعمالا وأكثر ضمانا لاحترام مبدأ المشروعية، حيث سنتعرض بالدراسة لجميع شروطها المطلوبة، والاختلاف الذي عرفته من حيث الإجراءات قبل تعديل قانون الإجراءات المدنية والإدارية وبعد تعديله. The study deals with a topic that is considered one of the most important topics of administrative law, These lawsuits differ from each other in terms of their subject, purpose, and also in terms of the conditions required in them inCivil and Administrative Procedures Law. In the second part, the study also deals with one of the most important administrative action, which is the annulment action, which is the most widely used and more guarantee of respect for the principle of legality, as we will present all its conditions required in Civil and Administrative Procedures Law. The study deals with a topic that is considered one of the most important topics of administrative law, which is represented in administrative lawsuits, which are a tool that imposes on the administration respecting the law, through the administrative judge correcting or consellation the administrative acts, in addition to compensating individuals for the damages caused by the administration, during the exercise of administrative activity. In the second part, the study also deals with one of the most important administrative action, which is the annulment action, which is the most widely used and more guarantee of respect for the principle of legality, as we will present all its conditions required in Algerian legislation.
