الملخص

الملخص: تهدف هذه الدراسة إلى تسليط الضوء على أهمية الانتخابات بوصفها الأداة الأمثل لاختيار الحكام، مع التأكيد على أن تحقيق انتخابات حرة ونزيهة يعتمد بشكل أساسي على وجود إدارة محايدة تضمن العدالة والشفافية، بعيدًا عن الانحياز لأي جهة تسعى للمشاركة السياسية. إلا أن حياد الإدارة هدف يصعب تحقيقه في ظل خضوع الإدارة للسلطة السياسية، مما يؤدي إلى سوء استخدام الوظيفة الإدارية، ويخلق شعورا وإحساسا لدى المواطن بعدم الانسجام والاستجابة المتولدة عن تصرفات الإدارة المنحرفة على أرض الواقع، لأن أخطر ما يعاب عليه من دور الإدارة، هو الفرق بين الواقع الملموس والقانون، هذا الامر دفع بالمشرع الجزائر إلى تدارك الأمر، بسن قوانين وآليات رقابية جديدة لتسليط الضوء على شفافية ونزاهة العملية الانتخابية، ممثلة في الهيئة المستقلة للانتخابات، إلى جانب المحاكم الإدارية والمحكمة الدستورية. باعتبارهما من مستلزمات العمل الرقابي. Abstract: This study aims to highlight the importance of elections as the most effective means of selecting leaders, emphasizing that achieving free and fair elections fundamentally relies on the presence of a neutral administration that ensures justice and transparency, without favoring any party seeking political participation. the administration’s subordination to political authority, which leads to the misuse of the administrative function and creates the feeling and feeling of the citizen of the lack of harmony and responsiveness generated by the administration’s deviant actions on the ground, because the most dangerous thing that the administration’s role suffers from is the difference between the tangible reality and the law, The Algerian legislature recognised this by enacting laws such as the Constitutional Court and the Administrative Courts
