الملخص

تضمن التعديل الدستوري لسنة 2020 العديد من التعديلات التي مست منظومة الحقوق والحريات، وذلك من خلال توسيعها كما وكيفا، حيث تم النص على 44 مادة ناظمة للحقوق والحريات من المادة 34 إلى المادة 77، كما قام المؤسس الدستوري بوضع ضمانات جديدة، أهمها تكريس مبدأ الأمن القانوني وبنص صريح، ما يعد مكسبا دستوريا يضمن استقرار التشريعات المتعلقة بالحقوق والحريات، بالإضافة إلى تعزيز آلية الدفع بعدم الدستورية كوسيلة بيد الأفراد تمكنهم من الولوج إلى القضاء الدستوري، أين تم إضافة النصوص التنظيمية إلى جانب القوانين التي يسمح بالطعن فيها بعدم الدستورية. Abstract: The constitutional amendment of 2020 included many amendments that affected the system of rights and freedoms, by expanding it quantitatively and qualitatively, as 44 articles regulating rights and freedoms were stipulated from Article 34 to Article 77. The constitutional founder also established new guarantees, the most important of which is the establishment of the principle of legal security in an explicit text, which is a constitutional gain that guarantees the stability of legislation related to rights and freedoms, in addition to strengthening the mechanism of pleading unconstitutionality as a means in the hands of individuals that enables them to access the constitutional judiciary, where regulatory texts were added alongside the laws that allow for challenging them for unconstitutionality
