فسخ الرابطة الزوجية ....... أسبابه و آثاره

الملخص
الملخــــــص: الزواج حل استمتاع الرجل بالمرأة على الوجه الشرعي، فيتم ارتباطهما بموجب عقد. هذا العقد الذي ينبغي أن يخضع في تمامه لأركان و في صحته لشروط يجب توفرها. مع ذلك، قد يتم عقد الزواج دون أن رضا الزوجين، أو دون أن يكون أحدهما أهلا للزواج، فيبطل العقد و يبطل معه الزواج. كما يمكن أن يتم الزواج دون حضور ولي المرأة أو الشهود أو دون تسمية للصداق، و هو ما يؤدي إلى فساده. لذلك، يفسخ العقد عند ثبوت فساده، و من ثم تتأثر العلاقة الزوجية بذلك الفسخ خاصة إذا تم الدخول بالزوجة، و يتأثر الأولاد أيضا إن وجدوا. و تختلف آثار الزواج الفاسد قبل الدخول بالزوجة عن تلك الآثار التي تكون بعد الدخول بها. فالعدة و النسب و التوارث من أهم ما تتأثر بها العلاقة الزوجية من زواج فاسد. فالزوجة من زواج فاسد سوف تعتد عند الدخول بها، و نسب الأولاد يثبت بالرغم من فساد الزواج، و تبقى مسألة التوارث بين الزوجين حيث لا يتوارث الزوجان من زواج فاسد إذا تم فسخ الزواج، أما إذا لم يتم فسخه، فالزواج يبقى قائما و يرث كل من الزوجين الآخر إذا توفي قبل الفسخ. Abstract : Marriage is the solution of a man's enjoyment of a woman in a legal manner, and they are bound by contract. This contract, which must be subject in its entirety to the elements and in its validity to the conditions that must be met. However, a marriage may be concluded without the consent of the spouses, or without one of them being eligible for marriage, and the contract is annulled and the marriage is annulled. Marriage can also take place without the presence of the woman's guardian or witnesses or without naming the dowry, which leads to its corruption. Therefore, the contract is terminated when it is proven to be corrupt, and then the marital relationship is affected by that annulment, especially if the wife is entered, and the children are also affected, if any. The effects of a corrupt marriage before entering the wife differ from those that occur after entering into it. The waiting period, lineage and inheritance are among the most important things that affect the marital relationship from a corrupt marriage. The wife of a corrupt marriage will count when entering into it, and the lineage of the children is proven despite the corruption of the marriage, and the issue of inheritance between the spouses remains, as the spouses do not inherit from a corrupt marriage if the marriage is dissolved, but if it is not dissolved, the marriage remains in place and each of the spouses inherits the other if he dies before the dissolution.
