سلطة القاضي الدستوري بين دواعي التقييد وحماية المشروعية الدستورية The Autority Of The Constitutional Judge Between The Reasons For Restriction And The Protection Of Constitutional Legitimacy

الملخص
يلعب القاضي الدستوري دورا حاسما في إرساء دعائم المشروعية الدستورية، بمراقبة مدى التزام جميع السلطات باحترام القاعدة الدستورية وتحديدا بضمان عدم انحراف المشرع عن محتواها، لكن مباشرته لهذه الرقابة لا تتم بسلطة مطلقة. من خلال هذا المقال سنتناول مختلف الحدود التي يقع على عاتقه الالتزام بها، بغية تحقيق معادلة صعبة بين حماية الدستور وعدم التعدي على السلطة التقديرية للمشرع، حفاظا منه على التوازن السياسي والاستقرار المؤسساتي، ومنعا من تحوله الى مشرع سلبي او ايجابي، سنتناول أيضا بالتحليل مدى انعكاس ذلك على المشروعية الدستورية، ومدى تأثر أدائه الرقابي والتفسيري والانشائي في ظل قيود ذاتية اثقلت كاهله ونصوص قانونية حددت نطاق ولايته. : The constitutional judge plays a crucial role in establishing the fondations of constitutional legitimacy by monitoring the exent to which all autorities adhere to the constitutional rule ,specifically by ensuring that the legislator does not deviate from its content , however the exercise of this judicial review is not done with absolute power. Through this article we will explore the various limitations wich the constitutional judge must adhere to strike a delicate balance between protecting the constitution and not infringing on the legislator’s discretionary power , thereby maintaining political balance and institutional stability,and preventing the judge from becoming either a negative or positive legislator,we will also analyze the impact of these limitations on constitutional legitimacy and how they affect the judge’s interpretive and review functions and constructive performance,in light of self-restraints that weigh heavily on him and legal texts that define the scope of his jurisdiction
