الملخص
ألزم التشريع الجزائري طالبي الزواج على تقديم وثيقة طبية تثبت الوضعية الصحية لهما، حين تعديله لقانون الأسرة في سنة 2005، وفي المقابل تم اغفال ذكر إلزامية تقديم التحاليل الطبية المتعلقة بمتلازمة نقص المناعة المكتسبة، والذي يعد من بين أكثر الأمراض المتنقلة والمعدية فتكا وشيوعا في الحياة الزوجية، وبالتالي قيد القانون كلا من الطبيب والضابط العمومي من افشاء المعلومات الطبية المتحصل عليها، حول المريض طالب الزواج لشريكه أو شريكته، والا سيكونون محل متابعة جزائية على أساس جريمة افشاء الأسرار المهنية والطبية. Algerian legislation required marriage applicants to submit a medical document confirming their health status, when the legislator modified the family code in 2005, in return, the obligation to present medical tests of immunodeficiency syndrome (AIDS) was omitted. Which is one of the most deadly and common infectious diseases in conjugal life, The law therefore restricts both the doctor and the public officer from revealing the medical information obtained about the patient requesting marriage to his or her partner, or else, they would be subject to penal prosecution on disclosure of professional and medical secrets.
