الملخص
ملخص: من خلال هذا المقال العلمي، تم تسليط الضوء على حصانة الهيئات العليا للرقابة المالية (مجلس المحاسبة ،والمجلس الأعلى للحسابات)، والتي تعتبر جوهر استقلاليتها وفق توصيات الهيئات الدولية للرقابة المالية،فإذا كانت استقلالية الهيئات الرقابية نتيجة لمبدأ الفصل بين السلطات، فإن جوهر الاستقلالية هو الحصانة سواء كجهاز يتمتع بنظام قانوني، وإمكانيات مالية ومادية يضمن له الحصانة والاستقلالية، أو كأعضاء يكفل لهم القانون حماية قانونية من التدخلات التي قد تؤثر على سير عملهم الرقابي، خاصة في مسألة عزلهم أو نقلهم، وتشمل حصانة الهيئات العليا للرقابة المالية أيضًا الحصانة الوظيفية المتمثلة في ضمان حرية تحديد البرامج العملية السنوية، وحماية قراراتهم. الكلمات المفتاحية: الفصل بين السلطات، حماية قانونية؛ مجلس المحاسبة ؛المجلس الأعلى للحسابات ؛ الحصانة؛ الاستقلالية. Abstract: Through this scientific article, the immunity of the supreme financial oversight bodies (the Accounting Council and the Supreme Council of Accounts) was highlighted, which is considered the essence of their independence in accordance with the recommendations of the international financial oversight bodies, If the independence of the oversight bodies is a result of the principle of separation of powers, then the essence of independence is immunity. Whether as a body that enjoys a legal system and financial and material capabilities that guarantee its immunity and independence, or as members to whom the law guarantees legal protection from interference that may affect the conduct of their supervisory work, especially in the issue of their removal or transfer. The immunity of the Supreme Financial Supervision Bodies also includes functional immunity, which is to guarantee the freedom to determine annual practical programs, and to protect their decisions.
