أثر علم الكلام في علم أصول الفقه: مدرسة الفقهاء الأصولية انموذجا

الملخص

يعتبر علم الكلام من العلوم التي أرست ظلالها على العديد من العلوم الإسلامية الأخرى، ومنها علم أصول الفقه، فقد جعل علم الكلام مما يستمد منها علم الأصول، ومعلوم أن التأليف في أصول الفقه قد اتخذ طرقا متنوعة، منها مدرسة المتكلمين أو طريقة الجمهور التي اشتهر عنها التأثر بالصنعة الكلامية. ومنها ما يعرف بطريقة الفقهاء الأصولية، أو طريقة الأحناف، وذلك حين تأثر أصحاب هذا الطريقة بالفروع الفقيهة تأثرا كبيرا، فجعلت الفروع الفقهية أصولا للاستنباط، كما نجد وفي هذه الدراسة حاولنا أن نتبين التأثير الكلامي في مدرسة الفقهاء، فنبرز بذلك جانبا آخر من جوانب هذه الطريقة التي اقترن اسمها بالفقه العملي، ونحاول أن نبين الاستمداد الحاصل في هذه الطريقة من علم الكلام. وتبعا لذلك نتعرف على الفروق الكامنة بين أصولي سمرقند وأصولي العراق داخل نفس الطريقة، وهل كان نفس الحضور الكلامي عند كل طائفة. . Abstract: The Islamic theology or the science of Kalam has an impact on varied science in islam, and the fundamental of jurisprudence or Osol Al fikqh is one of the science that influenced by the theology. That’s why many scholars mentioned that science of kalam is one of the sources of Osol Alfikh. As for the mode of writing in osol alfikh, there are two main classical approaches, in one hand the theoretical approach or Tarikat Almutkalimin. And on the other hand the deductive approach or Tarikat Alfokahaa’. This study aims to show the impact of theology on the fundamental of jurisprudence or Osol Alfikh with example of the deductive approach or Tarikat Alfokahaa’, because this approach is known by the impact of islamic law or alforo’ Alfikhya, so this study aims to show an other side in this approach. And how the deductive approach derived from the science of Kalam ? Key words: The Islamic theology; The fundamental of jurisprudence; The deductive approach.
