The exclusion of state regulatory texts related to certain monetary and banking activities and their replacement by regulations issued by the Monetary and Banking Board as an independent administrative authority under legislative authority (Law No. 23-09) raises several questions regarding the extent to which the legislative enshrinement of these regulations aligns with constitutional texts. These constitutional texts exclusively grant regulatory authority to the President of the Republic and the Prime Minister or Head of Government, as applicable, rather than to other independent authorities and bodies. However, these questions have been met with various answers justifying the legitimacy of these regulations, whether from a constitutional, judicial, or jurisprudential perspective.
