العلل المحتملة لحديث النهي عن لبس الحرير للرجال وأثرها في حكم لبس الحرير الصناعي

الملخص
ملخص تناول هذا البحث مسألة تحريم لبس الحرير على الرجال، من جهة تعليل هذا الحكم عند المتفقهين فيه، وأبرز أسباب اختيار هذه المسألة: أهمية البحث في عِلَل الأحكام الشرعية، فهذا النوع من البحث التعليلي يُقَوِّم النظر الفقهي ويُسَدِّدُه، وفيه تقويمٌ للاستدلال بالقياس، وتقوم هذه الدراسة على الإشكالية الآتية: ما علة النهي عن لبس الحرير للرجال؟ ويسعى البحث إلى الإجابة عليها وفق المنهج الوصفي والتحليلي، وذلك في محاور هي: تحليل التعليلات التي قيلت، والاستدلال لها، ثم المقارنة بينها للوصول إلى معرفة التعليل الأنسب، ثم تناول أثر تعليل حكم هذه المسألة على مسألةٍ معاصرة، ألا وهي مسألة لبس الحرير الصناعي، ومن أبرز النتائج التي تم التوصل إليها: أن أقوى التعليلات لتحريم الحرير على الرجال: أن الحرير للرجال من نعيم الجنة، وأنه حُرِّم عليهم لئلا يتعجَّل أحدهم هذا النعيم في الدنيا، وأن هذه العلَّة قاصرةٌ على الحرير، لذلك لا يمكن تعديتُها إلى الحرير الصناعي ولا إلى غيره. Abstract This research deals with the issue of prohibiting men from wearing silk, from the point of view of the reasoning of this ruling among the scholars, and the most prominent reasons for choosing this issue are the importance of research on the reasons for legal rulings, as this type of explanatory research evaluates and corrects the jurisprudential consideration, and evaluates the inference by analogy, and is based on the following question: What is the reason for prohibiting men from wearing silk? The research seeks to answer it according to the descriptive and analytical method, in the following axes: Analyzing the explanations that have been given, reasoning for them, then comparing them to reach the most appropriate explanation, then addressing the impact of the explanation of the ruling of this issue on a contemporary issue, namely the issue of wearing artificial silk: The strongest reasoning for the prohibition of silk for men is that silk for men is one of the blessings of Paradise, and that it is forbidden for them so that none of them will rush to this blessing in this world, and that this reason is limited to silk, so it cannot be extended to artificial silk.
