أخيرًا، يؤكد البحث على أهمية تعزيز الوعي القانوني بحق خيار الرؤيا لضمان فهم الأطراف المتعاقدة لحقوقهم وتحقيق العدالة في المعاملات. x Abstract: This study aims to analyze the Option of Inspection as a mechanism to ensure sufficient knowledge of the sold item in sales contracts, through a comparative study between Palestinian Civil Law and the Majalla of Judicial Rulings. It seeks to highlight the similarities and differences between the two legal systems and propose solutions to bridge the legislative gaps that may impact the realization of justice between contracting parties. The research examines the condition of sufficient knowledge of the sold item as a fundamental requirement for the validity of sales contracts, with a focus on the Option of Inspection, which grants the buyer the right to accept the sold item or rescind the contract after inspecting it, ensuring the buyer’s protection and achieving balance in contracts. The study addresses the issue of how both Palestinian Civil Law and the Majalla of Judicial Rulings regulate the condition of sufficient knowledge of the sold item and the adequacy of current legal provisions in achieving this goal. The research employs a comprehensive scientific methodology, including a descriptive-analytical approach to describe and analyze the relevant legal texts, a comparative approach to examine the provisions in Palestinian Civil Law and the Majalla of Judicial Rulings, and an inductive approach to derive precise conclusions from legal and jurisprudential texts. The research concludes that the Option of Inspection is an effective tool to ensure knowledge of the sold item, but its application differs between Palestinian Civil Law and the Majalla. While Palestinian law allows the waiver of this option, the Majalla adopts a stricter stance. Additionally, describing the sold item in the contract is considered sufficient for knowledge under Palestinian law, contrary to the apparent provisions of the Majalla. The study also finds that the Option of Inspection is a personal right that does not transfer to heirs and is extinguished upon the buyer's death. Moreover, the buyer's material or legal actions with respect to the sold item negate the right to exercise the Option of Inspection. The study recommends amending Article 429 of Palestinian Civil Law to make it clearer and more comprehensive. It also suggests allowing the waiver of the Option of Inspection, provided it is in writing and conditional upon the absence of fraud or deception. Furthermore, it proposes revising Article 335 of the Majalla to include both material and legal actions as grounds for extinguishing the Option of Inspection. Finally, the study emphasizes the importance of raising legal awareness about the Option of Inspection to ensure contracting parties understand their rights and to promote justice in transactions Option - Material and Legal Acts - Buyer Protection - Rescission of the Contract
