بيع التركة في التشريع الجزائري

الملخص
الملخص: تطرق المشرع الجزائري إلى بعض أنواع البيوع الخاصة في القانون المدني، ووضع لها أحكام خاصة تختلف عما هو عليه الأمر في البيع العادي، ومن ضمن هذه البيوع؛ بيع التركة، هذا الأخير نظمه المشرع في المواد من 404 إلى407، وهو عقد يبيع فيه الوارث نصيبه الآيل إليه من تركة مورثه، كله أو جزء منه، دون تحديد مشتملاته، مقابل ثمن نقدي، يتم دفعه من طرف المشتري، ولا يتم هذا البيع إلا بعد موت المورث وثبوت الحق في الميراث وافتتاح التركة، ولا تنتقل فيه ملكية التركة تلقائيا بمجرد انعقاد العقد، وإنما تخضع لإجراءات أوجبها القانون لنقل كل حق من الحقوق المكونة للتركة.
