Today, it has become highly imperative to prevent abuse of monopoly, as described by the Competition Law, in order to restore balance in contractual relations, particularly after the emergence of powerful institutions in the production and distribution sectors. At the same time, it turned out that all abuses arising from a dominant position are not regarded as absolutely prohibited by law, since the basic concept of prohibition is conditional on a number of restrictions or exceptions, especially those related to "efficiency gains", such as the declaration of non-intervention which was properly accepted by the Algerian legislator. It is therefore entirely legally valid to express some complexity, and even perplexity, with respect to the principle of proscribing all abuses of monopoly.
