الحرية والمسؤولية في التشريع الإعلامي في الجرائر" قراءة قانونية وإعلامية للمرسوم التنفيذي " رقم 20-332 المؤرخ في 22 نوفمبر 2020

الملخص
اطلقت وزارة الاتصال الجزائرية ورشات إصلاحية من بينها ورشة الإعلام الالكتروني التي توجت سنة 2020 بإصدار المرسوم التنفيذي محل الدراسة، في أول خطوة من نوعها لتنظيم القطاع وضبط الفوضى في ظل التحول الرقمي ، وهو ما تهدف اليه هذه الورقة البحثية من خلال تسليط الضوء على بنود ذات المرسوم، لمعرفة ما اذا كان يستجيب لمستجدات المشهد الاعلامي في البيئة الرقمية بين مفهومي الحرية والمسؤولية ، ومن نتائج القراءة التحليلية لبنود المرسوم نجد ان اغلبها عكست نفس التوجه السابق ، من خلال تكريس السلطة لسياسة الاحتكار ، مع التشكيك في النوايا الصادقة في دمقرطة القطاع بالصورة التي تحقق الحرية في الرأي والتعبير القائم على التعدد وبمسؤولية اجتماعية ، مع طغيان القاعدة القانونية الآمرة التي غلبت عليها الصيغ الإلزامية ، وهو ما يؤكد سياسة التضييق و رقابة الدولة على القطاع وليس العكس Abstract :The Algerian Ministry of Communication launched reform workshops, including the electronic media workshop, which culminated in the issuance of the executive decree under study, in the first step of its kind to organize the sector and control chaos in light of digital transformation, which is what this research paper aims to achieve by shedding light on the provisions of the same decree, to find out Whether it responds to developments in the media landscape in the digital environment between the concepts of freedom and responsibility, From the results of the analytical reading of the provisions of the decree, we find that most of them reflected the same previous trend, by devoting power to monopoly policy, while questioning the sincere intentions to democratize the sector in a way that achieves freedom of opinion and expression based on pluralism and social responsibility, with the tyranny of the peremptory legal rule that dominated it. Mandatory formulas, which confirms the policy of restrictions and state control over the sector and not the other way around
