Medical Errors Resulting From Transplantation Of Human Organs Between Criminalization And Legal Protection

Abstract
Abstract : The transplantation of human organs is considered one of the most complex and risky surgical procedures, which may be accompanied by medical errors that can affect the lives of patients or donors. The aim of this research is to attempt to understand the general framework of these errors between criminalization and legal protection. The study concluded that legal regulations permit the transplantation of human organs when their principles are respected, and criminal liability ensues in case of violations of the rules governing the transfer and transplantation of human organs.. ملخص: نقل وزرع الأعضاء البشرية تعتبر من أصعب وأخطر العمليات الجراحية والتي يمكن أن تصاحبها أخطاء طبية قد تؤثر على حياة المرضى أو المتبرعين، وهدف هذا البحث الى محاولة معرفة الاطار العام لهذه الأخطاء بين التجريم و الحماية القانونية، وتوصلت الدراسة الى أن القواعد القانونية تتضمن إباحة عمليات زرع الأعضاء البشرية متى تم احترام مضامينها، وترتب مسؤولية جزائية في حالة مخالفة الضوابط التي تحكم نقل وزرع الأعضاء البشرية.
