الملخص

عرفت التجارة البحرية تطورا غير مسبوق نتيجة الانفتاح الاقتصادي على الأسواق الدولية، وما تطلبه ذلك من تنوع وسائط النقل ودخول عناصر عديدة في إتمام العملية التجارية البحرية، وهي العملية التي لا يمكن لها الاستغناء عن إجراء التأمين الذي يعد ركيزة أساسية في ضمان سلامة الملاحة البحرية بصفة عامة، ولهذا التداخل في العناصر أثر مباشر في جعل التجارة البحرية تواجه خطرا يختلف عن المخاطر التقليدية كالقرصنة والغرق، وهو الخطر المتعلق بالاحتيال التأميني من طرف المؤمن له بمناسبة التجارة البحرية الذي يسعى للاحتيال على شركات التأمين والغش في بيانات وثائق الشحن والتأمين قصد تحقيق أرباح غير مشروعة من وراء دفعه لأقساط التأمين، وهو ما يدفعنا إلى البحث في الصور التي يرد عليها الاحتيال بهذه المناسبة ومختلف الوسائل والآليات التشريعية المستحدثة لمواجهة هذه الجريمة. كلمات مفتاحية: الملاحةالبحرية،التأمين،احتيال،شركات التأمين، المؤمن له Abstract: Maritime trade has undergone unprecedented growth owing to economic openness to international markets, which has required several means of transportation and the participation of numerous elements in fulfilling the maritime commercial process. This process can not dispense without insurance, which is a crucial pillar in assuring maritime navigation security in general. This interaction of elements has a direct effect on maritime trade, exposing it to risks that differ from traditional threats such as piracy and sinking, particularly the risk of insurance fraud by the insured during maritime trade. Such individuals seek to defraud insurance companies and forge shipping and insurance documents to earn illegal profits from their insurance premiums. This induces us to investigate the forms of fraud that arise in this regard and the different legislative modes and mechanisms introduced to fight this crime.
