الملخص
يهدف هذا البحث إلى دراسة التعديلات التي مست إجراءات سير الدعوى الإدارية وبالخصوص التعديل الأخير لقانون الإجراءات المدنية والإدارية، وقانون التنظيم القضائي الجديد، والتي من خلالها سعى المشرع الجزائري إلى تبسيط الإجراءات وتعزيز دور القاضي الإداري، ومن خلال دراسة هذه المستجدات الإجرائية للدعوى الإدارية توصلنا إلى مجموعة من النتائج أهمها أن هذه التعديلات وإن كانت مستحسنة لكنها تبقى غير كافية وتحتاج إلى اهتمام تشريعي أكبر خاصة بعد استحداث محاكم الاستئناف الإدارية. This research aims to study the amendments to the procedures governing administrative proceedings, particularly the recent amendments to the Code of Civil and Administrative Procedure and the new Judicial Organization Law. Through these amendments, the Algerian legislator sought to simplify procedures and enhance the role of the administrative judge. Through a study of these procedural developments in administrative proceedings, we have reached a number of conclusions, the most important of which is that these amendments, although commendable, remain insufficient and require further legislative attention, especially after the establishment of administrative courts of appeal.
