ممارسة حق الدفاع في ظل العدالة الجنائية الرضائية

الملخص
تعتبر العدالة الجنائية الرضائية آلية جديدة ضمن إجراءات الدعوى العمومية،وهي تقتضي الاعتراف بدورالخواص على اختلاف مراكزهم القانونية (مشتبه فيه،جاني،متهم،ضحية) في التعامل مع منظومة الإجراءات والضمانات التي تداربها الدعوى العمومية،وإزاء الاعتراف بدورالخواص الذي يتخذ شكل اتفاق عقدي او تصرف بإرادة منفردة ف يشكل تنازل عن بعض الضمانات،تمنح للأفراد في الدعوى العمومية مساحة لتكريس رضاهم والاعتداد به ضمن نطاق الشرعية الإجرائية خاصة من الحقوق والضمانات المتعلقة بممارسة حقوق الدفاع ومستلزماتها اثناء مرحلتي التحقيق القضائي Consensual criminal justice is a new mechanism within the public prosecution procedures, and it requires recognition of the role of hawas, regardless of their legal positions (suspect, perpetrator, accused, victim) in dealing with the system of procedures and guarantees in which the public prosecution is conducted, and towards the recognition of the private role that takes the form of an agreement A contract or act unilaterally in the form of a waiver of some guarantees, which gives individuals in the public lawsuit a space to devote their satisfaction and respect it within the scope of procedural legitimacy, especially from the rights and guarantees related to the exercise of defense rights and their requirements during the two stages of the judicial investigation.
