دور مجالس الصلح العرفية في تجسيد العدالة الرضائية (خنشلة نموذجا)

الملخص
تفاقمت الظاهرة الإجرامية وكثرت الملفات المعروضة أمام القضاء، الذي أصبح يعاني مما يسمى أزمة العدالة ،مما اقتضى البحث عن بدائل للدعوى العمومية، إذ كرست عدة أنظمة مختلفة نظام الصلح والوساطة والتسوية وغيرها كأنظمة للقضاء على هذه الأزمة وأشهرها نظام الصلح الذي عرفه المجتمع منذ التاريخ، حيث تشكلت مجالس تسمى مجالس الصلح العرفية مهمتها الفصل في مختلف القضايا ، وقد ساهمت هذه المجالس في تجسيد العدالة التصالحية في المجتمع، ووضع حد لتفاقم هذه القضايا عن طريق إجراء الصلح بين أطراف الخصومة بالرغم أن قانون الإجراءات الجزائية لم ينص عليها The Criminal phenomenon has worsened, and the number of files presented before the judiciary has increased, leading to what is now known as a"justice crisis." This situation has necessitated the search for alternatives to public lawsuits. Several different systems have established mechanisms like reconciliation, mediation, settlement to address this crisis, the most notable of which is the reconciliation system, which has been known to society since ancient times. customary reconciliation councils were formed, tasked with resolving various disputes. These councils have played a significant role in embodying restorative justice within the community and curbing the escalation of these issues by facilitating reconciliation between the parties in conflict, despite the fact that the Code of Criminal Procedure does not explicitly provide for them.
