صكوك الاستصناع الاسلامية و إستشراف تطبيقها من طرف المؤسسة الوطنية للترقية العقارية

الملخص
ملخص: تهدف هذه الدراسة الى تسليط الضوء على صكوك الإستصناع كصيغة تمويلية شرعية بديلة في يد الحكومات. في هذا المجال عرضنا التجربة المصرية مع اصدار الصكوك السيادية بصيغها المختلفة (استصناع ،مرابحة،..)،اضافة الى تقديم دراسة استشرافية حول آلية تطبيق صكوك الاستصناع في الجزائر من طرف المؤسسة الوطنية للترقية العقارية"ENPI "في تمويل مشاريعها الاسكانية ،تم الاعتماد على المنهج الوصفي التحليلي و الاستقرائي خلصت الدراسة الى ان صكوك الإستصناع تسمح بتجسيد العديد من المشاريع .رغم ما حققته التجربة المصرية من ايجابيات الا أنها واجهة العديد من الانتقادات ،و محدودية تداولها عالميا عكس باقي انواع الصكوك . الكلمات المفتاحية : صكوك الإستصناع ؛ الصكوك السيادية ؛مصر ؛ "ENPI " . Abstract: This study aims to highlight istisna 'a instruments as an alternative legitimate funding formula in the hands of governments. In this area we presented the Egyptian experience with the issuance of sovereign instruments in different formats (istisna 'a, Murabaha,..) In addition to the presentation of a forward-looking study on the mechanism for the application of istisna 'a instruments in Algeria by the National, Real Estate Promotion Corporation"ENPI" Financing its housing projects Reliance on analytical and inductive descriptive curriculum. The study concluded that istisna 'a instruments permit the incarnation of many projects Despite the positive results of the Egyptian experience, it is the face of many criticisms, and its limited global circulation reflects other types of instruments.
