The Israeli Violations Of Palestinian Prisoners Rights

Abstract

We aim through this study to present the violations carried out by Israel's occupation in prisons against Palestinian civilian detainees and prisoners of war. Through these practices, the occupation aims to extend the occupier's control by using the policy of detention and imprisonment to torture the Palestinian people and to destroy their rights to their land. Considering the category of resistance fighters as ordinary prisoners and not as prisoners of war, this calls for the necessity of intervention to uncover these violations and to contribute to the application and activation of the rules of international law to restore the full rights of the occupied Palestinian people in light of the unprecedented international silence. This study recommends the necessity of defending the rights of detainees and prisoners in accordance with international human rights law, international humanitarian law, and the various legal instruments emanating from them. نهدف من خلال هذه الدراسة إلى دراسة الانتهاكات التي يقوم بها الاحتلال الاسرائيلي في السجون بحق المعتقلين المدنيين والأسرى ، حيث يهدف الإحتلال من خلال هذه الممارسات لبسط سيطرت المحتل باستعمال سياسة الاعتقال والزج في السجون دون أي سبب مع اعتبار المقاومين كسجناء عاديين وليسوا كأسرى وهذا ما يستدعى ضرورة القيام بكشف هذه الانتهاكات وفضحها والمساهمة من أجل تطبيق قواعد القانون الدولي لاسترجاع كامل حقوق الشعب الفلسطيني المحتل في ظل الصمت الدولي غير المسبوق ، حيث توصي هذه الدراسة بضرورة الدفاع عن حقوق السجناء من المعتقلين و الأسرى طبقا لما تضمنه القانون الدولي لحقوق الانسان والقانون الدولي الانساني ومختلف الصكوك القانونية المنبثقة عنهما.
