الآليات القانونية لحماية قواعد البيانات في البيئة الرقمية

الملخص
إستقطبت قواعد البيانات إهتمام التشريعات الدولية ،، نظرا لأهميتها البالغة كونها نتاج لثورة معلوماتية وتطور تكنولوجي ، وضعها أمام حتمية إيجاد قاعدة قانونية متناسقة لضمان الإستفادة منها وإستغلالها دون المساس بحقوق الأفراد والمؤسسات. خاصة بعد استفحلت ظواهر الإعتداء عليها من خلال إختراقها ، تسريبها او اعادة بيعها وحتى محوها في سبيل المنافسة غير المشروعة دون إهمال الخطر الذي تمثله على خصوصية الأفراد وأمن معلوماتهم الشخصية. ورغم الجدل القائم حول تعريفها فإن أغلب القوانين الدولية إعتبرتها مصنفات رقمية مشمولة بحماية قوانين حق المؤلف والحقوق المجاورة بل إن بعض الدول كالإتحاد الأروبي قد إعتبرت حمايتها ضمن الحقوق الأساسية لذا كرست مجموعة من اللوائح والمواثيق التي تعنى ببسط الحماية القانونية لها، ولم يكن المشرع الجزائري بمعزل عن هذه التطورات، فقط قام بإستحداث سلطة وطنية من اجل ضبط النشاطات املتعلقة بقواعد البيانات وترخيص الإستفادة منها بالإضافة إلى معالجة المشاكل والقضايا المتعلقة بها. Databases have attracted the attention of international legislation, due to their great importance as a result of the information revolution and technological development, which placed them before the imperative of finding a consistent legal basis to ensure their utilization and exploitation without prejudice to the rights of individuals and institutions. Especially after the phenomena of attacking it increased through penetration, diversion, resale, and even erasure for the sake of unfair competition, without neglecting the danger it poses to the privacy of individuals and the security of their personal information. Despite the controversy surrounding its definition, most international laws considered it digital works covered by the protection of copyright laws and related rights. Indeed, some countries, such as the European Union, considered their protection among the basic rights, so they devoted a set of regulations and charters that deal with extending legal protection to them, and the Algerian legislator was not isolated from With these developments, he just created a national authority in order to control the activities related to databases and license to benefit from them, in addition to addressing the problems and issues related to them.
