The Methodology Of Ibn Habib Al-maliki (d. 238 Ah) And Its Impact On His Jurisprudential Preferences

Authors : Bouhalouane Omar . Okacha Houalef .

Abstract

The Maliki school of thought is characterized by two distinct methodologies. The first prioritizes authentic hadith over practice, giving precedence to raised hadith. The second relies on hadith supported by practice and prioritizes them accordingly. The latter approach was predominantly adopted by Egyptian students of Malik, led by Abdul Rahman ibn al-Qasim. The first approach was championed by Medinese students, led by Ibn al-Majshun, with support from Egyptians like Ibn Wahb. Although Ibn Habib was a later figure, he was known among the Andalusians for adhering to this methodology. This research highlights the significance of Imam Ibn Habib within the Maliki school by examining his opinions on various jurisprudential issues, clarifying his methodology, and noting the attention given to his views by scholars. The findings confirm that while Ibn Habib respected Malik's opinions, he was independent-minded, upholding the truth as he perceived it, even when it contradicted his Imam’s views.
