الملخص
يسعى واضع القانون لتحقيق أهداف معينة، ولأجل ذلك يسن نصوصا، ويستعمل في صياغتها مناهج علمية وتقنيات منهجية للوصول إلى النتائج المرجوة. فسلامة التطبيق وإن كانت مرتبطة بحسن الصياغة، بيد أن حسن التطبيق قد يتلافى سوء الصياغة غالب الأحيان، فعمل القاضي والشارح عند استنباط الأحكام هو في ذاته تقويم للنص وإزالة لغموضه وتلافي للإشكالات التي قد يؤدي إليها تطبيقه الحرفي، مما يقتضي اللجوء لدلالة ومقاصد الألفاظ وفحواها احتراما للقواعد التشريعية والنظام العام لتحقيق الأمن والاستقرار التشريعي، فعيوب تفسير النص وسوء تطبيقه يهدران صياغته السليمة. The drafter of the law seeks to achieve certain goals, and for that purpose he enacts texts and uses scientific methods and systematic techniques in their formulation to reach the desired results. Although sound application is linked to good wording, good application may avoid bad wording in most cases, the judge's and the commentator's work in sentencing is itself an assessment of the text, removing its ambiguity and avoiding the problems that its literal application may lead to. This requires recourse to the meaning, purposes, and content of words in response to legislative rules and public order to achieve security and legislative stability. The flaws in interpreting and misapplying the text are undermining its proper formulation. application and interpretation.
