الشرط المشدد في التعهد بنقل ملكية عقار The Aggravating Condition In The Pledge To Transfer Ownership Of A Property

الملخص
تقسم المسؤولية المدنية الى مسؤولية عقدية واخرى تقصيرية , تعتبر احكام الاخيرة من النظام العام التي لا يجوز الاتفاق على ما يخالفها ولاسيما فيما يتعلق باتفاقات تعديل المسؤولية الا اللهم كان ذلك الاتفاق تشديدا للمسؤولية , فهو جائز في المسؤولية العقدية والتقصيرية , اما الاولى _ أي المسؤولية العقدية _ فأن الاحكام المنظمة لها لا تعتبر من النظام العام وبالتالي يجوز الاتفاق على ما يخالفها بالإعفاء والتخفيف والتشديد , وفي موضوع بحثنا سنتناول احدى تطبيقات الشرط المشدد في العقود المدنية , وهو عقد بيع العقار خارج دائرة التسجيل العقاري ( التعهد بنقل ملكية عقار ) , ولاسيما ما يتعلق بمقدار التعويض الذي يستحقه المتعهد له في حال اخلال المتعهد بالتزامه المفروض عليه بنقل الملكية الى المشتري. Civil liability is divided into contractual liability and other tortious ones, and installment provisions of the public order that it is not permissible to agree on anything that contradicts them, especially with regard to agreements to modify liability, except by God, if that agreement increases liability, it is permissible in contractual and short-term liability. As for the first - that is, contractual liability - then Its provisions are not considered part of the public order, and therefore what violates them must be agreed upon with exemptions and severe mitigations, and in what we discussed, we will discuss the applications of strict technology in civil contracts, which is contracting to sell the property outside the real estate registration department (undertaking to transfer ownership of a property), especially with regard to the compensation that is due. The pledgee has in the event of a contract the pledgee and the pledgee for the transfer of ownership to the buyer.
