إشكالية إسناد النشاط الإداري الضار لشخص عام محدد في دعوى المسؤولية الإدارية

الملخص
إن الشخص المتضرر من تصرفات الإدارة لا يمكنه الحصول على التعويض عن الضرر إذا لم يفرق بين الإدارات المختلفة، ويتعرف على الشخص العام المراد إحالته على الدعوى ، وإلا رفضها القاضي ، وقد يبدو هذا الأمر سهلا للوهلة الأولى إلا أنه قد تثار حالات يصعب فيها تحديد الشخص العام المسؤول لوجود تداخلات في الاختصاصات ، فقد تتعاون مجموعة من الأشخاص العامة في نفس النشاط سواء باتفاقهم أو لأن القانون ينص على ذلك، ، أو في حالة الوصاية الإدارية التي قد تثير مشكلا إسناديا ،ضف إلى ذلك حالة الازدواج الوظيفي ، حيث يتدخل بعض الأعوان تارة باسم شخص عام ، وتارة باسم شخص آخر . وفي ميدان الأشغال العمومية أين يصعب تحديد الشخص المسؤول لوجود عدة قابلين لإدخالهم في الخصومة كصاحب المشروع والمقاول والمشارك وصاحب الامتياز. Any person who has suffred damage caused by the administration cannot be entitled to compensationif he fails to differentiate between the administrations and to identify the administration against which the action must be brought under penalty of the rejection of his action by the judge ,which may seem easy at first,but we noticed some cases where it was very difficult to identify the responsible public person because of an interplay of jurisdictions, often several public persons can collaborate in the same activity either by consent between them, or because the law stipulates it,as it is the case for the administrative guardianship which may raise an attribution issue,and the case of a dual function,where sometimes certain agents may intervene on behalf of a public person and sometimes on behalf of another person, or in the field of public works where it is very difficult to determine the responsible person because of the existence of serval people who could be implicated such as the main contractor,the contractor, the master of the work and the co-contractor or the concessioner
