البلاغة القانونيَّة الدستوريَّة المقارنة

الملخص
الاستلام: اليوم /الشهر/السنة تاريخ القبول: اليوم /الشهر/السنة الملخَّص إذا كانت البلاغة الجديدة تعد فنًا اقناعيًّا، فإن المحاكمات القضائية الدستورية تحسب بأنها عملية تواصلية حجاجية، وعلى الرغم من أنها تعتمد على المنطق؛ فإنها لا تخلو من السعي للاستمالة، والتي تتعارض مع الشطط في الحكم، ولذا فإن بلاغة الأحكام القضائية الدستورية، وبلاغة المحامين الدستوريين ترتكز على مبدأ الهزيمة والفوز/ الرابح والخاسر، ولذا تسعى هذه الدراسة لتجاوز ذلك المنطق الأرسطي وبيان تفاعلات البلاغة والثقافة، وكيفية الوصول إلى الاقناع، إذ إن التفسير الدستوري بث لروح جديدة أو معانٍ جديدة للنص الدستوري، ويدل الخطاب على مراكز القوة والسلطة، وقد تختلف البلاغة القضائية باختلاف الطبقة والجنس مثل إضافة الأردنيات في النص الدستوري الأردني لتعديلات 2021، وتتباين بتوجه القضاء نحو الانسجام أو الحلول الفردية، وتأثير القيم الديمقراطية على البلاغة الدستورية، ولقد وظفت الدراسة المنهج المقارن بين أنظمة دستورية عربية وغربية، والملاحظة المباشرة نتيجة عمل الباحث في المحاماة، وخلصت الدراسة إلى أن البلاغة القضائية الدستورية الأردنية تنزع نحو الانسجام في النظام السياسي، والفردية تجاه الالتزامات، والتراتبية النمطية في الجنس. Abstract If the new rhetoric is the art of persuasion, constitutional court trials are reckoned as an argumentative communicative process, and though it relies on logic; It is not devoid of striving to woo, which contradicts the abuse of judgment, and therefore the eloquence of constitutional judicial rulings, and the eloquence of constitutional lawyers are based on the principle of defeat and win / winner and loser, and consequently this study seeks to transcend that Aristotelian logic and clarify the interactions of rhetoric and culture, and how to reach persuasion The constitutional interpretation broadcasts a new spirit or new meanings to the constitutional text, and the discourse indicates the centers of power and authority, and judicial rhetoric may vary according to class and gender, such as adding Jordanian women to the Jordanian constitutional text for the 2021 amendments, and it varies with the judiciary’s orientation towards harmony or individual solutions, and the impact of democratic values. On constitutional rhetoric, the study employed the comparative approach between Arab and Western constitutional systems and direct observation due to the researcher’s work in the legal profession.
