التعسف في إستعمال حقوق الجوار

الملخص

تعتبر نظرية التعسف في إستعمال الحق من النظريات التي تم تأصيلها حديثا، كما أن هناك العديد التي من القضايا أو المسائل التي تندرج تحتها، و من بين تلك المسائل حقوق الجوار، معنى ذلك أن الشخص أو الفرد له حقوق يتمتع بها ليتمكن من العيش قي بيئته بسلام و التصرف في ملكه بأريحية، إلا أنه إذا تعسف في إستعمال تلك الحقوق و تسبب بها بضرر لجاره أو لجيرانه فإنه يمنع من ذلك شرعا و قانونا،كما أوجب المشرع الجزائري على المالك بألا يتعسف في إستعمال حقه إلى حد يضر بجاره في المادة691من القانون المدني الجزائري، كما نص على معايير التعسف في المادة 124مكرر من القانون نفسه. كما يترتب على التعسف في إستعمال حقوق الحوار جزاء أو تعويض، و يكون تعويضا عينيا فيزال فيه الضرر جزئيا أو كليا، أو تعويضا بمقابل مادي و يكون ذلك اتفاقيا أو بحكم القاضي أو بنص القانون. Abstract: The theory of abuse in the use of the right is considered as a theory which has been recently rooted.There are several issuess that belongs to it as well.Among them.there is the neighborhood right wich provides the individual which provides the individual with a safe and peaceful atmosphere within his or her property.However.this individual is prohibited by the force of law and legislations to use the rights arbitrarily or harm the neighbhors.The Algerian legislator forbid the use of reights in harming the neighbors according to article691 of the Algerian civil law. Arbitrariness mesures are also mentioned in the repeated article 124 from the same law.Using the neighborhood rights arbitrarily leads to penalty or compensation whish can be partial or full.The compensation can also be by agreement.by judge’s verdict or by a legal text.
