أثر وفاة المتعاقد وإفلاسه على تنفيذ العقد الإداري-دراسة مقارنة-

الملخص
يمكن أن تطرأ بعض الظروف أثناء تنفيذ العقد الإداري، بحيث تتغير الوضعية القانونية للمتعاقد بتعرُّضه لوقائع طبيعية(الوفاة) أو أحكام قانونية (الإفلاس) من شأنها التأثير على مركزه القانوني، ومن ثمة التأثير على تنفيذ العقد الإداري ككل؛ لهذا تهدف هذه الدراسة إلى البحث عن المعالجة القانونية لهذه الحالة ضمن المرسوم التنفيذي 21-219 باعتباره أحدث نص قانوني في هذا الإطار. وقد خرجت الدراسة بمجموعة ملاحظات تُأخذ على هذا المرسوم بعد مقارنته بباقي الحلول القانونية المقارنة. Abstract: In the course of the execution of the public contract, this last one may be subject to certain circumstances when the legal status of the contractor may change because of its exposure to natural events (the death) and legal rules (bankruptcy) and thereby affect the execution of the public contract in its entirety. Therefore, this study aims to search the legal treatment of this case within the 21-219 executive decree, as it is the latest legal text in this context. In addition, the study came out with some observations against this decree after comparing it with the other comparative legal solutions
