الملخص
ملخص : إن الأموال العامة لها أهمية كبيرة باعتبارها العصب الرئيسي للنظام الاقتصادي في الدولة، فهي بحاجة إلى حماية من كل الاعتداءات، باعتبارها عرضة للجرائم المالية وللفساد ،لذلك اهتمت التشريعات العالمية و الوطنية ووضعت حماية خاصة لها في ظل تطور وسائل و طرق تبديدها، فالمشكل يطرح في الاختلاف الموجود في تحديد مفهوم الاموال العامة الخاضعة للحماية سواء في القانون او الفقه مما يصعب تحديد مكوناتها وما ينتج عنه من استبعاد بعض الاموال العامة من الحماية القانونية.Abstract: Public funds are of great importance as the main nerve of the economic system in the country, as they need protection from all attacks, as they are vulnerable to financial crimes and corruption. Therefore, global and national legislations have taken care and placed special protection for them in light of the development of means and methods of their waste, so the problem arises in the difference. What exists in defining the concept of public funds subject to protection, whether in law or jurisprudence, which makes it difficult to determine its components and the resulting exclusion of some public funds from legal protection
