أصول التشريع في الحقوق والواجبات الزوجية بين المنقول والمعقول ومدى مراعاتها في الاتفاقيات الدولية والقوانين الداخلية

الملخص
يبحث مضمون هذه المداخلة في الحقوق والواجبات بين الزوجين داخل الأسرة. ليس من أجل سرد هذه الحقوق وعدها. وإنما من أجل الكشف عن الأصول والمبادئ التي ينبغي مراعاتها في تقرير حق معين أو تعديله أو إلغائه. وقد صُدِّر الكلام فيها بالحديث عن المبادئ العقلية التي لا تصطبغ بأي صبغة دينية أو إيديولوجية سوى العقل الصحيح، حتى تكون صالحة لأن تطرح على طاولة النقاش مع المخالف ومن باب أولى مع الموافق. فكانت مبادئ ثلاثة. ظهر من خلال المطلب الثاني توافقها الجلي مع أصول التشريع الإسلامي في هذا الموضوع لتبرز ما هو ثابت سلفا وتؤكده أبدا من خاصية الفطرة لهذا الدين. ثم تثلث المداخلة بالحديث عن المناقضة الصريحة في الاتفاقيات والمواثيق الدولية في شؤون الأسرة والمرأة لتلك المبادئ العقلية وتكشف عن أبعاد وأسرار دعواتها لتعديل التشريعات الداخلية المتعلقة بالأسرة في هذا الموضوع. The content of this intervention examines rights and duties between spouses within the family. Not to list and count these rights. Rather, it is in order to reveal the principles that should be taken into account when determining, amending, or abolishing a specific right. The discussion in it was introduced by talking about rational principles that are not tinged with any religious or ideological color other than sound reason, so that they are suitable to be put on the table for discussion with those who disagree and, a fortiori, with those who agree. There were three principles. The second requirement revealed its clear compatibility with the principles of Islamic legislation on this subject, highlighting what is already established and eternally confirmed regarding the innate characteristic of this religion. Then, she completes the intervention by talking about the clear contradiction in international agreements and covenants in family and women’s affairs to those rational principles, and It reveals the dimensions and secrets of its calls to amend internal legislation related to the family on this issue.
