The general theory of contracts which traditionally relied on the principle of freedom of contract, experienced a long period of rigidity and stability , as this principle was considered the cornestone for organizing contractual relations, assuming equality between the parties and granting each full liberty to conclude the contract and determine its content without external interference. However ,this classical conception no longer reflects practicalreality, paticularly with the rapide devlopment of economic transactions and the émergence of neyy forms of contracting ,foremost among them electronic contracting ,which is conducted remotely through non-traditional means in an environment domnated by technical complexity and an imbalance between the parties, especially between professionals and electronic consumers, who oftn lack technical expertise and sufficient knowledge of contractual terms. In addition, they rely on pre-formulated standarrd contracts that cannot be negotiated. In light of these transformations , legal scholars found themselves compelled to reconsider many classical rules of the general theory of contracts.the principle of freedom of contract has thus been constrained by a set of legal mechanisms aimed at achieving contractual balance , while legislators have enacted specific rules to regulate e-commerce and provide effective consumer protection .consequently, the general theory of contracts has transitioned from a stage of rigidity to one of flexibility, adapting to economic and technological devlopments without abondoning its foundational principles , through the reformulation of its rules to achieve contractual justice.
