The Consolidation Of Real Property Ownership Under Algerian Legislation

Authors : Hadjadj Mabrouk . Ramoul Khaled .

Abstract

This research is devoted to the problem of the consolidation of real property ownership according to Algerian legal legislation, seen as a legal and economic means of solving the problem of fragmentation and dispersal of immovable property, regardless of whether agricultural or urban real estate, and restructuring them as a coherent unit for their optimal use. This research starts from the theoretical approach to the notion of real property ownership, and the motives underlying the need for its consolidation, moving on to legal instruments of its consolidation, either consensual or contractual, as well as regulatory ones managed by the state. This is followed by an examination of the practical difficulties of implementing these legal instruments in practice, which include the widespread phenomenon of undivided co-ownership (chuyu'), insufficient land registry, and the diversity of legal systems regulating real estate in Algeria.
