The licensee of a registered trademark occupies a legally exposed position under Algerian law: it derives its right to use the mark entirely from a contractual relationship with the proprietor, it bears substantial commercial risk in building and operating a business around that use. This article examines the extent to which Algerian law, principally Ordinance No. 03-06 of 19 July 2003 on Trademarks read together with the general law of contract, protects the licensee against the principal risks it faces: the licensor's failure to maintain or defend the registration, third party infringement of the licensed mark, arbitrary termination, and the consequences of registration formalities. The article argues that, while the licensee benefits from meaningful contractual and administrative safeguards, its protection remains structurally weaker than that of the proprietor itself, and it proposes targeted legislative clarifications capable of narrowing this gap.
