The Hisba System In The Islamic World Between Originality And Borrowing, And Its Influence On Islamic And European Societies

Abstract
This study analyses the concept of hisba in the Islamic world by examining a range of texts written by different authors to determine if the institution was original to Islamic civilization. It also considers the positions of leading Muslim scholars, among them al-Mawardi, al-Ghazali, Ibn Khaldun, and Ibn Taymiyyah, this explains how the institution developed and what role it played in Muslim societies. The significance of the study lies in clarifying how Islamic society benefited from the hisba system and how far it shaped European societies that came into contact with the Islamic world, in times of peace or war. تهدف هذه الدراسة إلى تحليل مفهوم الحسبة في العالم الإسلامي، من خلال استعراض مجموعة من النصوص لمؤلفين مختلفين، بهدف التحقق من أصالتها أو مدى تأثرها بأنظمة أخرى. كما تسلط الضوء على آراء كبار العلماء المسلمين، مثل الماوردي، والغزالي، وابن خلدون، وابن تيمية، مما يساهم في فهم تطور هذا النظام ودوره في المجتمعات الإسلامية. وتبرز أهمية الدراسة في توضيح مدى استفادة المجتمع الإسلامي من نظام الحسبة، ومدى تأثيره على المجتمعات الأوروبية التي احتكت بالعالم الإسلامي، سواء في فترات السلم أو الحرب.
