الملخص

الملخص: يعالج هذا المقال التحول الذي شهده الفكر الدستوري المعاصر في تصوره لوظيفة الدستور،من مجرد منظومة نصية ذات سمو شكلي إلى بنية معيارية و قيمية متكاملة تتفاعل مع متطلبات الواقع الدستوري المُتجدد. وينطلق البحث من العلاقة الوظيفية بين المعيارية الدستورية والكتلة الدستورية والفعالية الاجتهادية،باعتبارها حلقات مترابطة في بناء عدالة دستورية تتجاوز الرقابة الشكلية إلى حماية الحقوق والحريات والقيم الدستورية. كما يتناول البحث اتساع المرجعية الدستورية من خلال مفهوم الكتلة الدستورية ، و ما يتيحه ذلك من إمكانات لتوسيع مجال الرقابة واستحضار المبادئ والقيم و المقاصد الكامنة في البناء الدستوري. وفي هذا السياق ،تبرز الوظيفة التفسيرية للمحكمة الدستورية باعتبارها أداة لتحديد الدلالة القانونية للنصوص وربطها بالتحولات الاجتماعية والقانونية ،دون الانفصال عن حدود النص أو الحلول محل المؤسس الدستوري. وتتأسس الدراسة على فرضية مفادها أن فعالية الدستور لا تتحقق بمجرد سموه الشكلي، وإنما بقدرته على إنتاج آثار قانونية فعلية من خلال مؤسسات العدالة الدستورية. ومن ثم ،تمثل الفعالية الاجتهادية آلية لتجسيد المعيارية الدستورية، وتوسيع مرجعيتها عبر الكتلة الدستورية، وتحقيق التوازن بين السلطة والحرية، و حماية جوهر الحقوق والحريات ،وتعزيز الأمن الدستوري. Abstract: This article examines the transformation of contemporary constitutional thought in its understanding of the function of the Constitution, moving from a merely formal and hierarchically superior text toward an integrated normative and value-based framework capable of responding to evolving constitutional realities. The study focuses on the functional relationship between constitutional normativity, the constitutional bloc, and jurisprudential efficacy as interconnected components of constitutional justice. Constitutional review thereby moves beyond formal conformity toward the substantive protection of rights, freedoms, and constitutional values. The article also examines the expansion of the constitutional reference framework through the concept of the constitutional bloc and its role in incorporating constitutional principles, values, and purposes. In this context, the interpretative function of the Algerian Constitutional Court serves to determine the legal meaning of constitutional provisions and relate them to evolving social and legal realities, while remaining within the limits of the constitutional text and constituent authority. The study argues that constitutional effectiveness cannot be reduced to formal supremacy. It depends on the Constitution’s capacity to produce concrete legal effects through constitutional justice institutions. Jurisprudential efficacy therefore gives practical effect to constitutional normativity, expands its reference framework, balances public authority and individual freedom, protects the essence of rights and freedoms, and strengthens constitutional security.
