Abstract: This article examines the experience of the Cambodian hybrid courts in prosecuting leaders of the Khmer Rouge, as a distinctive model reflecting the interaction between national sovereignty and international criminal justice. It focuses on analyzing the legal and institutional framework of these courts, highlighting the efforts of the Cambodian state to assert its judicial sovereignty in the face of the United Nations’ role. The study also explores the manifestations of this approach through control over the court’s composition and judicial proceedings, as well as the limits of international oversight. It concludes that this experience reflects a complex balance between the requirements of international justice and considerations of national sovereignty, raising legal questions about the effectiveness and independence of the hybrid model.
