Contractual Liability For Ai‑generated Damages In Autonomous Decision‑making Systems

Authors : Hassani Lamia .

Abstract

Abstract : Private law is undergoing a significant transformation due to the growing use of artificial intelligence in contractual processes, particularly in negotiation, the formation of intent, and the performance of obligations. AI is no longer merely a tool, but an influential actor that raises complex issues concerning will, consent, and the determination of the moment of contract formation. It also creates challenges for contractual liability, given the multiplicity of potential sources of error, including programming, data, and human oversight. These difficulties are further exacerbated by the use of AI in contract analysis and in assessing the feasibility of breach, thereby complicating the attribution of liability in the event of disputes.
