The Legal Basis Of The Consignee’s Status In The Maritime Carriage Of Goods Contract

Abstract
It is legally established that a contract has a relative effect. If it is issued fulfilling its elements and conditions for its validity, its effects will extend to its contracting parties without extending to others. The principle of proportionality of contracts represents the legal barrier to existing contractual ties in a way that does not allow its effects to extend except to its contracting parties only, or to their public and private successors under certain conditions. However, despite this, we find that the judiciary has exceeded this principle in some cases, and departed from the general rule, and the most important of these cases is The position of the addressee in the maritime transport contract. Although he is not a party to the contract that was originally concluded between the carrier and the shipper, but rather he is from the group of third parties. However, the judiciary has recognized his rights and imposed on him obligations arising from this contract. Therefore, a great controversy has arisen in jurisprudence and judiciary about the position of the addressee in the maritime transport contract. من المقرر قانونا أن للعقد أثر نسبي ، إذا ما صدر مستكملا لأركانه وشروط صحته انصرفت آثاره إلى عاقديه دون أن تمتد إلى غيرهما ، وتمثل مبدأ نسبية العقود الحاجز القانوني للروابط العقدية القائمة بما لا يسمح بانصراف آثارها إلا لعاقديها فحسب ، أو إلى خلفهما العام والخاص بشروط معينة ، إلا أنه بالرغم من ذلك نجد أن القضاء قد تجاوز هذا المبدأ في بعض الحالات ، وخرج عن القاعدة العامة وعلى رأس هذه الحالات مركز المرسل إليه في عقد النقل البحري ، فهو وإن كان ليس طرفاً في العقد الذي أبرم أساساً بين الناقل والشاحن ، وإنما هو من طائفة الغير إلا أن القضاء قد اعترف له بحقوق وألقى عليه بالتزامات ناشئة عن هذا العقد، ولهذا فقد ثار جدل كبير في الفقه والقضاء حول مركز المرسل إليه في عقد النقل البحري.
