The Paradox Of European Digital Sovereignty: Between Liberal Defence And Regulatory Fragmentation

Abstract
ملخص: تتناول هذه الدراسة السيادة الرقمية الأوروبية بوصفها عنصرًا محوريًا في المنافسة الجيوسياسية المعاصرة. وتركّز على التناقض البنيوي بين سعي الاتحاد الأوروبي للحفاظ على فضاء رقمي ليبرالي ومفتوح وقابل للتشغيل البيني، وبين الضرورة الجيوسياسية للدفاع ضد «تسليح الاعتماديات». وهو سياق يطرح تساؤلًا حول ما إذا كانت السيادة الرقمية للاتحاد الأوروبي معرّضة لتناقض بنيوي بين الانفتاح الليبرالي والتجزئة الرقمية (الإنترنت المجزأ) Splinternet. تفترض الدراسة أن اعتماد هذه الاستراتيجية الدفاعية يسهم في تعميق التجزئة من خلال إنشاء حواجز تنظيمية وقانونية. وقد اعتمدت الدراسة منهجية تحليلية نوعية شملت تحليل السياسات، ودراسة حالة لتقنية الجيل الخامس (5G)، إضافة إلى مقارنة بين النماذج الأوروبية والأمريكية والصينية. وأظهرت النتائج أن أدوات الاتحاد الأوروبي، اللائحة العامة لحماية البيانات (GDPR)، وقانون الخدمات الرقمية (DSA)، وقانون الأسواق الرقمية (DMA) قد عززت قوته التنظيمية، لكنها ساهمت أيضًا في تعميق التجزئة الرقمية. Abstract: This study examines European digital sovereignty as a central element in contemporary geopolitical competition. It focuses on the structural contradiction between the European Union’s quest to maintain a liberal, open and interoperable digital space, and the geopolitical necessity of defending against the ‘weaponisation of dependencies’. A context that questions whether the European Union’s digital sovereignty is exposed to a structural contradiction between liberal openness and digital fragmentation (Splinternet)? The study posits that the adoption of this defence strategy contributes to deepening fragmentation by creating regulatory and legal barriers. The study employed a qualitative analytical methodology comprising policy analysis, a case study of 5G, and a comparison of European, American and Chinese models. The results showed that the EU’s instruments (GDPR, DSA, DMA) have strengthened its regulatory power but have contributed to deepening digital fragmentation.
