الملخص

تهدف هذه الدراسة إلى البحث في قادح من قوادح القياس، عند الإمام الفندلاوي المالكي من خلال كتابه تهذيب المسالك، وقد ذكرت فيها بيان القوادح ومنه الفرق واعتباره قادحا من عدم ذلك عند علماء الأصول، ثم ذكرت نماذج من اعتراضات الفندلاوي على أقيسة الخصوم بقادح الفرق، بعد تتبعها في مواضعها وجمعها وتحليل طريقة الإعتراض. وقد اتجهت نحو موضوع مهم من موضوعات علم الأصول، وقد تجلى في هذه الدراسة قيمة المؤلف وكتابه، وأهمية الفرق عند العلماء، كما اتضح جريان المؤلف على ما عليه أرباب المذهب من أصول. is study aims to investigate one of the dialectical objections to legal analogy (Qawādiḥ al-Qiyās), specifically the objection of distinction (Qādhiḥ al-Farq), according to the Maliki jurist Imam Al-Fandālāwī through his book Tahdhīb al-Masālik. The study provides an clarification of these defeaters, including the concept of distinction (Al-Farq), and explores the debates among Ushulists (scholars of Islamic jurisprudence) regarding its validity as a legitimate objection. Furthermore, it examines contextual models of Al-Fandālāwī’s objections against his opponents' analogies using this specific defeater, after meticulously tracing, compiling, and analyzing his dialectical methodology across various sections of his work. This research addresses a pivotal topic within the field of Uṣūl al-Fiqh (Principles of Islamic Jurisprudence). The study underscores the academic value of both the author and his treatise, highlights the significance of distinction (Al-Farq) among jurists, and demonstrates the author’s adherence to the foundational principles of his specific jurisprudential school (Madhhab)
