الملخص
الملخص: تهدف الدراسة إلى معرفة الإختصاص القانوني لكل من الديوان الوطني للحظيرة الثقافية الطاسيلي ناجّر، والديوان الوطني للسياحة، عند تعاملهما مع تحديات التحول الرقمي لقطاع السياحة، حيث توصلت الدراسة إلى إعتبار عملية الرقمنة للتراث الثقافي المادي وغير المادي هي الخطوة العملية الأولية التي يجب على السلطات العمومية القيام بها لتحقيق التحول الرقمي لقطاع السياحة فيما بعد، وهذا لا يتم بالحصول على التكنولوجيا وحدها فقط، بل لابد من إجراء تغييرات شاملة وفي الكثير من المجالات. وعليه تم التأكيد على توصيات مهمة كمراجعة جميع النصوص القانونية التي تضبط نشاط المرافق العامة وتظهر فيها الدولة صاحبة سلطة وسيادة، بعدما تجاوزها عصر الذكاء الإصطناعي وثبت أن بعض النصوص القانونية التي تنظم الديوان الوطني للحظيرة الثقافية الطاسيلي ناجّر والديوان الوطني للسياحة صارت تعرقل عمليات الرقمية والتحول الرقمي لقطاع السياحة. Abstract: The study aims to determine the legal jurisdiction of both the Tassili N’Ajjer Cultural Park and the National Tourism Office in their engagement with the challenges of digital transformation within the tourism sector. The findings indicate that the digitization of both tangible and intangible cultural heritage constitutes the primary and practical step that public authorities must undertake to lay the groundwork for the subsequent digital transformation of the tourism industry. This process, however, cannot be achieved solely through the acquisition of technology; rather, it necessitates comprehensive reforms across multiple domains. Accordingly, the study underscores several important recommendations, notably the need to review all legal frameworks governing the activities of public institutions, where the state assumes authority and sovereignty. The rationale for this review lies in the fact that the era of artificial intelligence has rendered many existing legal texts obsolete. It has been demonstrated that certain legal provisions regulating the Tassili N’Ajjer Cultural Park and the National Tourism Office have become obstacles to digitization initiatives and to the broader digital transformation of the tourism sector.
