The Foundations Of The Criminal Liability Of The Pharmacist In Algeria

Abstract
According to law n ° 18-11 relating to health, the pharmacist is responsible for the delivery and manufacture of medicines. The pharmacist in particular, is bound to a set of bonds. He is the one who performs medical prescriptions and according to the products he delivers and the advice he gives, he is exposed to risks and this inevitably generates, a presumption of responsibility, disciplinary or civil, but also criminal. وفقًا للقانون رقم 18-11 المتعلق بالصحة، فإن الصيدلي مسؤول عن إصدار وصرف الأدوية وتصنيعها. الصيدلي صاحب الصيدلية على وجه الخصوص، مرتبط بمجموعة من الإلنزامات. كونه الشخص الذي يقوم بتنفيذ الوصفات الطبية ووفقًا للمنتجات التي يصرفها ويصدرها والنصيحة التي يقدمها، فهو معّرض لمخاطر وهذا يؤدّي حتما إلى مسؤولية قانونية، تأديبية أو المدنية، وحتّى جنائية.
