Abstract
It is widely acknowledged that cultural heritage is an essential element of community identity and social cohesion. In addition, the protection of cultural heritage inherited from previous generations should be of prime concern for all people, regardless of the category of heritage concerned. This could be intangible heritage, movable heritage, or even real estate heritage which includes historical monuments, archaeological sites, urban or rural complexes, as well as real estate by destination. Heritage safeguarding should be realized by means of clear and well-defined texts at the national as well as at the international levels. التراث الثقافي هو أحد مكونات هوية المجتمع وأساس التماسك الاجتماعي. تعد حماية التراث الثقافي الموروث من الأجيال السابقة، أولوية لجميع الشعوب بغض النظر عن صنف التراث المعني، تراث غير مادي، تراث منقول، أو حتى تراث عقاري. وتشمل الفئة الأخيرة المعالم التاريخية والمواقع الأثرية والمجمعات الحضرية أو الريفية، بالإضافة إلى العقارات حسب المآل. إن الحفاظ على هذا التراث لا يكون إلا من خلال نصوص واضحة على الصعيدين الوطني والدولي.
