شروط وإجراءات الحصول على صفة المرقي العقاري في التشريع الجزائري

الملخص
فرض المشرع الجزائري لاكتساب صفة المرقي العقاري رقابة قبلية؛ وذلك باشتراطه الحصول المسبق على الاعتماد وفق إجراءات محددة، إضافة إلى القيد في السجل التجاري، والجدول الوطني للمرقين العقاريين، وتهدف هذه الدراسة إلى إبراز مدى الحماية التي تحققها هذه الشروط و الإجراءات للمكتتبين. وقد توصلت الدراسة، بعد استقراء وتحليل النصوص التشريعية المتعلقة بشروط وإجراءات الحصول على صفة المرقي العقاري، إلى أن هذه المتطلبات تشكل ضمان لتنظيم مهنة الترقية العقارية، وتعزيز كفاءة الممارسين لها، وتضمن إنجاز المشاريع العقارية، وحماية أموال المكتتبين، ويمكن القول في الأخير أنه يتطلب الصرامة في تفعيل الرقابة القبلية والبعدية معا، تفاديا لإخلال المرقي العقاري بالتزاماته وبما يضمن تحقيق حماية شاملة للمكتتبين. The Algerian legislator has established ex-ante control for acquiring the status of a real estate developer by requiring prior accreditation in accordance with specific procedures, as well as registration in the Commercial Register and the National Register of Real Estate Developers. This study aims to highlight the extent of protection that these conditions and procedures provide to subscribers. Through the examination and analysis of the legislative texts governing the conditions and procedures for obtaining the status of a real estate developer, the study concludes that these requirements constitute an important guarantee for regulating the real estate development profession and ensuring the competence of its practitioners. They also contribute to the proper completion of real estate projects and the protection of subscribers’ funds. Finally, strict enforcement of both ex-ante and ex-post controls is required to prevent real estate developers from failing to fulfill their obligations, thereby ensuring comprehensive protection for subscribers.
