الهدية الدبلوماسية بين الضوابط الشرعية والمقاصد السياسية

الملخص
ملخص تُعدّ الهدية الدبلوماسية إحدى أدوات المجاملة الراقية في العلاقات الدولية، غير أنّها تتجاوز أحيانًا معناها البروتوكولي البسيط لتصبح وسيلة فاعلة في ممارسة السياسة الخارجية وتحقيق مصالح متعدّدة. فقد تُوظَّف أحيانًا لتحقيق التقارب وبناء جسور الثقة بين الدول، كما قد تنطوي على نوايا خفية تُحيلها إلى شكل من أشكال الرشوة السياسية، تُقدَّم خارج الأعراف المتعارف عليها بهدف التأثير في صانع القرار أو استدراج معلومات حساسة تمسّ أمن الدولة. ولا يقتصر الخطر على البعد السياسي فحسب، إذ يمكن أن تتحوّل الهدية إلى وسيلة أذى أو أداة تجسس تهدّد سلامة الدبلوماسي المهدى إليه أو تُعرّض الأمن القومي لبلده للخطر. ومن هنا تبرز أهمية ضبط هذا النوع من الهدايا بالتصريح الإجباري عنها، ومعرفة كيفية تقييمها والتصرّف فيها وفق القوانين المنظمة للعمل الدبلوماسي، ضمانًا للشفافية وصونًا للمصالح العليا للدولة. Abstract Diplomatic gifts are regarded as refined gestures of courtesy in international relations, yet they often extend beyond their simple protocol function to become influential tools in conducting foreign policy and pursuing various interests. At times, they are used to foster rapprochement and build bridges of trust between states; however, they may also carry hidden intentions that turn them into a form of political bribery offered outside official frameworks to influence decision-makers or extract sensitive information that threatens national security. The danger is not solely political, as a gift can also become a means of harm or a tool for espionage that endangers the diplomat receiving it or compromises the security of their country. Therefore, it is essential that such gifts be declared, properly assessed, and handled in accordance with the legal regulations governing diplomatic practice, ensuring transparency and protecting the state’s higher interests.
