أخلاقيات الاختلاف عند الإمام مالك: مظاهرها، أثرها في بناء المذهب ودروس منهجية معاصرة.

الملخص
ملخص: يتناول هذا البحث أخلاقيات الاختلاف عند الإمام مالك بن أنس من خلال بيان الجذور التي شكّلت رؤيته في التعامل مع الخلاف، مثل تنوع البيئة المدنية، وتعدد شيوخه، وأثر عمل أهل المدينة، إضافة إلى أثر ورعه العلمي في مواقفه الخلافية، كما يبرز مظاهر هذه الأخلاقيات في سلوكه العلمي، كالتواضع المعرفي، واحترام الآراء المخالفة، واجتناب الجدال العقيم، ويبين أثر ذلك في بناء خصائص المذهب المالكي، ويعتمد البحث على المنهج الاستقرائي والتحليلي، وذلك باستقراء المواقف والنصوص المروية وتحليلها لاستخلاص أبعادها المنهجية، وقد انتظم البحث في ستة محاور هي: مفهوم الاختلاف وأسبابه، والجذور المنهجية لفكر الإمام مالك في الاختلاف، ومظاهر أخلاقياته في سلوكه ومنهجه، ثم أثر هذه الأخلاقيات في بناء خصائص المذهب المالكي، وأخيرًا الدروس المنهجية المعاصرة المستفادة منها في توجيه الحوار العلمي وترشيد الخلاف الفقهي. Abstract : This study examines the ethics of disagreement in the thought of Malik ibn Anas. It explores the foundations that shaped his approach to scholarly disagreement, including the diversity of the Medinan environment, the plurality of his teachers, and the influence of the practice of the people of Medina, as well as the role of his piety in guiding his positions. The study highlights key ethical features of his scholarly conduct, such as intellectual humility, respect for opposing views, and avoidance of futile disputation, and explains their role in shaping the methodological characteristics of the Maliki school. The research adopts inductive and analytical methods by examining and analyzing reported statements and positions attributed to him to understand their methodological dimensions and derive lessons. The study is organized into sections addressing the concept and causes of disagreement, its methodological roots in Malik’s thought, its manifestations in his conduct, its impact on the Maliki school, and contemporary methodological lessons for constructive scholarly dialogue.
