Jurisdiction Over Disputes Involving Economic Control Bodies

Abstract

Although economic control authorities operate outside the scope of presidential authority and administrative supervision due to their organizational and functional independence, they nevertheless remain subject to judicial review. Their independence does not place them beyond the jurisdiction of the courts. This underscores the importance of the present study, which seeks to highlight the role of the judiciary in overseeing these authorities in the exercise of their powers and in adjudicating the disputes arising from them, particularly within the framework of a dual judicial system. Such oversight is essential to maintaining institutional coherence and reinforcing the principles of legality and the rule of law. Judicial intervention therefore constitutes a fundamental safeguard against the potential abuse of public authority. رغم تموقع هيئات الضبط الاقتصادي خارج نطاق الرقابة الرئاسية والوصاية الإدارية لما تتمتع به من استقلالية عضوية ووظيفية، إلا أنها ليست في حصانة من الرقابة القضائية، فخاصية الاستقلالية لا تمنع اختصاص القاضي، ومنه تظهر أهمية هذه الدراسة التي نهدف من خلالها إلى إبراز دور القضاء في الرقابة على هيئات الضبط الاقتصادي بمناسبة ممارستها لاختصاصاتها، وما ينشأ عن ذلك من منازعات خصوصا في ظل الازدواجية القضائية، وذلك من أجل المحافظة على تجانس النظام وتكريس مبدأ المشروعية وسيادة القانون، إذ يمثل تدخل القاضي ضمانة أساسية ضد كل تعسف في استعمال امتيازات السلطة العامة.
